Randwick Council in Sydney has passed a motion that will declare 10 beaches smoke-free, to provide health as well as environmental benefits as discarded cigarette butts should cease to be a problem. The New South Wales Smoke-Free Environment Act covers recreational areas such as swimming pools or playgrounds but not beaches. Among the popular beaches now to become smoke-free are Coogee, Maroubra and Clovelly

A jury in the District Court of New South Wales will hear a defamation suit launched against news web site operator Daily Mail Australia. It is being brought by Rachelle Louise, the lover of convicted murderer Simon Gittany, over claims that she was the "world’s most deluded woman" and a former striptease artist. Barrister Roger Rasmussen is acting on behalf of Louise, who has been ordered by judge Judith Gibson to pay the Daily Mail Australia’s legal costs incurred for the preliminary hearing

ASIC’s fresh bid to access telco intercepts

The Australian Securities & Investments Commission (ASIC) is urging the Government to grant it greater powers in the areas of search warrants and access to telecommunications data. The watchdog argues that traditional telephone intercepts are decreasing in importance due to the rise of online social media and the national broadband network roll-out. It also says it current search warrant procedures are not "entirely satisfactory" as enshrined in the ASIC Act and the Crimes Act. A former employee of the Whitehouse Institute of Design has pleaded guilty to accessing restricted data. She leaked information about a $A60,000 "chairman’s scholarship" awarded to Prime Minister Tony Abbott’s daughter, Frances Abbott. A sentencing hearing took place on 23 October 2014. The woman will be sentenced on 25 November

Petch challenges graft findings

Former Ryde City Council mayor Ivan Petch wants the Supreme Court of New South Wales to overturn an Independent Commission Against Corruption (ICAC) ruling that he engaged in corrupt conduct. Amongst other things, ICAC found that he tried to improperly influence the council’s former manager and deliberately disclosed confidential information. Petch was suspended from the city council in mid-2014

The Supreme Court of Western Australia heard evidence from Aaron Carlino on 21 October 2014. Carlino has been charged with the murder of Stephen Cookson in Decenber 2012. He claims that he was acting in self-defence when he shot Cookson and dismembered his corpse in order to dispose of the body. Carlino has pleaded guilty to manslaughter, and claims that he had been assaulted and threatened by Cookson in the months before he died

WA plan allows use of dead man’s sperm

The Western Australian Government plans to introduce reforms which will allow sperm to be used posthumously to enable a dead man’s partner to conceive. However, Health Minister Kim Hames has indicated that use of harvested sperm will only be permitted if the man gave permission to do so before his death. New South Wales and Victoria already have laws governing the use of sperm after death

Judge rejects Clive Palmer’s halt bid – now for the case

Supreme Court of Queensland judge David Jackson has ruled that a court case brought by Chinese state enterprise Citic against businesses of iron ore venture partner Clive Palmer will go ahead. It is alleged that he took more than $A12m out of a joint bank account and then used the funds to finance the 2013 federal election campaign of his Palmer United Party. Jackson conceded that a compromise solution put forward by Palmer’s Mineralogy vehicle should perhaps have been accepted by Citic before launching the legal action

Ambulance told to release response data

Victorian Freedom of Information Commissioner Lynne Bertolini has sided with the Ambulance Employees Australia union, and ruled that Ambulance Victoria should make public data on its response times for patients suffering heart attacks. An appeal to the Victorian Civil & Administrative Tribunal is possible, and the deadline of 60 days means that the information will likely not become available until after the November 2014 state election
