Supreme Court of New South Wales (NSW) judge Robert Allan Hulme has sentenced Mitchell Barbieri to 35 years’ imprisonment, with eligibility for parole after 26 years. Barbieri was allowed to plead guilty to manslaughter after initially having been charged with murder over the stabbing death of NSW police officer Bryson Anderson in late 2012. The perpetrator’s mother, Fiona Barbieri, has also received a jail term of 10 years with a minimum of seven years and six months for her role in the attack

Victorian police want to bring the state in line with New South Wales on laws regarding drunkenness. At present Victoria’s Liquor Control Reform Act makes a distinction between drunkenness and intoxication, while there is no such distinction in NSW. The Act includes a definition of intoxication but does not define what constitutes drunkenness. Victoria is the only state in which public drunkenness is still a criminal office

Pie Face hit with third New York lawsuit

The landlord of a retail outlet in New York for collapsed Australian fast food chain Pie Face has launched a Supreme Court case to recover $US620,000 ($A760,000), after the company allegedly caused structural damage to the building. This is the third law suit against Pie Face in New York, with another property owner also seeking $US50,000 in outstanding rent charges and a building firm demanding to be paid close to $US120,000 for work at one of the stores

Melbourne Magistrates Court was on 16 December 2014 told of the deceptions allegedly perpetrated by Andrew Jeffery Flanagan. He was made group GM strategy and business development at department stores chain Myer in mid-2014, but lasted just one day in the role before it emerged that he had faked the qualifications and experience on his resume. Flanagan has been granted bail ahead of a directions hearing on 17 December, and has been committed to stand trial on seven counts of fraud and theft. Psychiatrist sexually abused his patient

Supreme Court of Victoria judge Melissa Lee Daly has ruled that deregistered psychiatrist Francis Tudor Bostock must pay compensation of $A384,029 to a former patient. The woman had been sexually abused by the practitioner, who also claimed $A16,000 from Medicare for the sessions with her. Anne Shortall, principal at law firm Slater & Gordon, says the victim will seek the payment to be made in 2016, when Bostock’s self-declared bankruptcy ends

The New South Wales Director of Public Prosecutions withdrew a murder charge due to there being "no reasonable prospect of conviction". The trial of Brian Thomas Bradbury over the death of his wife in 2011 had been due to start in the Supreme Court. On 15 December 2014, a ruling was handed down that the state should compensate the accused for his legal costs. Acting Justice Jane Matthews noted the weak case of the Crown, which was based on circumstantial evidence

Violent nurse suspended after assaults

Western Australia’s State Administration Tribunal has suspended Michael Cummins’ registration as a nurse for 16 months. He pleaded guilty to charges of professional misconduct arising from incidents at two nursing homes. He had been accused of assaulting a dementia patient and a patient care assistant, as well as falsifying medical records and failing to give medication to patients. Cummins had previously been given a suspended jail sentence after pleading guilty to charges of assault

Court dismisses Palmer’s attempts to thwart Citic

Supreme Court of Western Australia (WA) judge James Edelman has ruled in a matter that forms part of the wider and drawn-out legal battle between Chinese state enterprise Citic Pacific and the Mineralogy vehicle of federal MP Clive Palmer. The latter had sought to have declared invalid two environmental permits held by Citic for the Sino Iron joint venture in WA. This was rejected by the court, and Edelman also criticised Mineralogy for attempting to drag out the proceedings even further
