Australia’s Fair Work Commission (FWC) has upheld an Aussie Waste Management employee’s claim that his dismissal for swearing at the managing director was unlawful. The garbage truck driver was summarily dismissed after using offensive language during a private telephone conversation with the executive. FWC deputy president Nicole Wells noted that swearing in some workplace’s is quite common in 2015, adding that the phone call was private and not overhead by other staff

The Australian Mines & Metals Association has raised concerns about the processes used to appoint members of the Fair Work Commission. It claims that 19 of the 27 commissioners that were appointed by the previous Federal Government have links to the Australian Labor Party or unions. This has been rejected by the Opposition’s shadow minister for workplace relations, Brendon O’Connor

Lend Lease victory in Barangaroo union fight

Australia’s Fair Work Commission has banned workers at Lend Lease Group’s Barangaroo South project in Sydney from engaging in unlawful strike action for three months. Some 1,000 members of the Construction, Forestry, Mining & Energy Union went on strike on 24 July 2014. The dispute centres on Lend Lease’s decision to stand down a union delegate in March after he raises concerns about safety at the construction site
