Westpac takes BBSW case down to the wire

National Australia Bank has joined the ANZ Bank in reaching a settlement with the Australian Securities & Investments Commission over rate-rigging allegations. The NAB is understood to have agreed to make a total payment of $A50 million, of which $A10 million would be seen as a penalty and $A20 million would go towards ASIC’s legal costs. The remaining $A20 million would be donated to a consumer protection fund. Westpac, the third bank involved in the bank bill swap rate case, is believed to be still considering whether it should challenge ASIC’s allegations in court.

ASIC win on bank swap rate rigging

The Australian Securities & Investments Commission’s case against Westpac, the ANZ, and National Australia Bank has been put on hold for two days. ASIC had accused the three banks of trying to rig the bank bill swap rate. However, the ANZ reported a day before the case was due to start that it had reached a settlement with ASIC, and it is understood that NAB may also do so. The deferment will allow ASIC’s deal with ANZ to be finalised and for it to be approved by the court. Outgoing ASIC chairman Greg Medcraft says the ANZ’s decision to settle the case vindicates its decision to pursue the case. It is believed that ANZ has agreed to pay a fine in the order of $A50 million.

NAB, CBA: We didn’t hike rates for profit

The Australian Prudential Regulation Authority requested in March that interest-only loans be capped at 30 per cent of all mortgages. National Australia Bank and Commonwealth Bank executives were asked by federal parliament’s economics committee on 20 October why they lifted rates for existing interest-only loan customers in the wake of APRA’s directive, with the suggestion being that they were motivated by profit. However, this implication was rejected by the bank executives.

Admitting guilt the clincher for rate-rig case

The Australian Securities & Investments Commission’s case against three of the "big four" banks over allegations that they manipulated the bank bill swap rate will be heard by the Federal Court on 23 October. Some observers believe that the parties could reach a settlement before the case begins, although this would require the banks to admit that they had engaged in unconscionable conduct. Meanwhile, stock exchange operator ASX Limited has issued new guidelines regarding bank bill trading in the wake of the BBSW scandal.

ASIC still gathering evidence against CBA: Medcraft

The Australian Securities & Investments Commission will shortly commence legal action against three of the nation’s four major banks over allegation that they manipulated the bank bill swap rate. However, ASIC chairman Greg Medcraft has told parliament’s economics committee that it is still investigating the Commonwealth Bank over rigging of the BBSW. The bank is also being investigated by ASIC for possible breaches of its continuous disclosure obligations regarding the money-laundering scandal.

Time is past for banks royal commission policy

Australian banks are attracting increased regulatory scrutiny in the wake of the Commonwealth Bank’s money-laundering scandal. This has weakened the Australian Labor Party’s case for a royal commission into banks, as such an inquiry would take some time to set up if Labor wins the next federal election. Meanwhile, Labor may not be able to act on the inquiry’s recommendations until after the following election. Labor increased the Australian Securities & Investments Commission’s regulatory powers when it was previously in government, and it could so again without the need for a royal commission.

Banks use rules to stifle rivals: Morrison

Federal Treasurer Scott Morrison says changes to the banking sector’s regulatory regime are needed as established banks are using the existing rules to stymie competition and make it hard for new players to enter the market. He has told a Bloomberg forum that the Federal Government’s proposed regulatory changes are aimed at empowering bank customers. Foreign regulators focus on CBA

The Australian Prudential Regulation Authority’s inquiry into the Commonwealth Bank of Australia continues to weigh on the banking sector. There is concern that CBA may come under scrutiny by APRA’s overseas counterparts in the wake of its money-laundering scandal. Credit Suisse has reduced its share price target for CBA by 10 per cent and warned of a governance crisis at the bank. Brian Johnson of CLSA notes that CBA could potentially incur much harsher penalties in offshore jurisdictions for breaching money laundering laws than in Australia.

APRA probe risks CBA rating

CBA CEO Ian Narev has described the review, which follows a series of scandals at the nation’s largest bank, as a "positive and constructive step". However, ratings agencies S&P Global and Fitch have warned that CBA’s credit rating could be downgraded if the review results in any adverse findings.
