The banking royal commission’s interim report urged the Australian Securities & Investments Commission to be aggressive in enforcing the Banking Code of Conduct. Australian Small Business & Family Enterprise Ombudsman Kate Carnell has backed the commission’s call for ASIC to be more proactive in enforcing the Banking Code of Conduct, while she has suggested that many small businesses will be disappointed by the commission’s interim report.

Risk of credit crunch is real and rising, UBS warns

Jonathan Mott of UBS has told clients that Australian banks’ profits are likely to come under pressure in the next several years as a result of the financial services royal commission. He says the risk of a credit crunch has been heightened following the release of the inquiry’s interim report. Mott adds that amongst other things, the final report is likely to recommend extending responsible lending obligations to small and medium enterprises and an overhaul of the way banks verify the expenses of borrowers.

Hayne to leave banks with billion-dollar bill

Australia’s major banks face years of litigation and costly settlements as a result of the banking royal commission. Law firm Maurice Blackburn has already flagged plans for legal action over a number of issues, including the calculation of household expenses prior to loans being approved. Omkar Joshi of Regal Funds Management says he is reminded of the UK’s payment-protection insurance scandal, which ended up costing UK banks Stg40 billion. Hugh Giddy of Investors Mutual says it is hard to deny that banks have made loans to some people who were not in a position to borrow money.

Costello slams ASIC for banks’ appalling acts

Future Fund chairman Peter Costello says the banking royal commission should look into the failings of the Australian Securities & Investments Commission in responding to misconduct in the financial services sector. The former federal treasurer argues that while the misconduct of banks has been appalling, ASIC bears some responsibility for allowing it to occur. Costello forecasts that the royal commission will result in lower profits in the banking sector, while financial advice will cost more and it will become harder to obtain credit.

APRA prepares to approve three new banks

There is speculation that the Australian Prudential Regulation Authority could grant full banking licences to fintech start-ups Volt Bank, 86400 and Judo Capital by the end of 2018. They would be subject to the same capital requirements as other banks, while gaining the trust of consumers will be a challenge. However, they should benefit from a lack of legacy IT systems and branch networks, as well as negative sentiment toward traditional banks in the wake of the royal commission.

Industry funds demand banks and super split

Industry Super Australia chairman Peter Collins says the banking royal commission’s revelations regarding retail superannuation funds warrant the separation of super from banking. Collins says those who thought that industry super funds might fare badly under the commission’s scrutiny got it wrong. He says the commission has shown that the industry funds sector was right to run its controversial "fox and henhouse" advertising campaign, which claimed that the $600 billion pool of default savings would be at risk if the government allowed the banks to access it.

NAB admits to breaking law once a week

A document released by the banking royal commission show that National Australia Bank breached the terms of its financial services licence a total of 297 times between 2014 and 2017. Some 110 of these breaches were deemed to be serious, yet the majority of them were not reported to the corporate regulator within 10 days. The document also shows that 84 per cent of the significant breaches that were not reported within the required time-frame occurred during the 2014-15 financial year.

APRA’s stress test draws fire on detail

The Australian Prudential Regulation Authority has released the results of its latest stress test of the banking sector. Commenting on the results, APRA chairman Wayne Byres said banks need to get improved data on customers’ overall debt position, as well as coming up with better crisis plans. Digital Finance Analytics’ Martin North is critical of the lack of public detail in the stress test, while APRA has also been criticised by some economists for its very optimistic view of the state of Australia’s $1.7 trillion mortgage sector.

Formula behind CBA’s record $700m penalty revealed

Documents submitted to the Federal Court show that the Commonwealth Bank’s flawed rollout of its intelligent ATMs accounted for $A180m of the $A700m fine that it received for breaching anti-money-laundering and terrorism financing laws. The bank was also fined $A170m for failing to undertake sufficient due diligence on customers who were subsequently found to have been drug traffickers or terrorists. Other penalties included a $A125m fine for failing to provide Austrac with more than 55,000 threshold transaction reports in a timely manner.
