The ANZ Bank’s appeal against the blocking of its deal to buy Suncorp Bank continued before the Australian Competition Tribunal on Tuesday. Cameron Moore SC, who is representing Suncorp Group, contended that the $4.9bn deal would not undermine competition in the banking sector, as Suncorp Bank is a relatively small player that had until recently been losing market share in its home state of Queensland. He also argued that a merger between Suncorp Bank and Bendigo Bank would not make financial sense for shareholders of either company.

Qantas flights detailed before Joyce sale

Documents filed in the Federal Court show that on 29 May Qantas provided the Australian Competition & Consumer Commission with the details of more than 18,000 flights it had cancelled. This was just three days before chairman Richard Goyder approved the sale of $17m worth of the airline’s shares by former CEO Alan Joyce. The ACCC has launched legal action alleging that Qantas had engaged in false, misleading or deceptive conduct by selling tickets for flights that it had already cancelled.

Qantas bows to ACCC wishes and ends China Eastern tie-up

Qantas has advised that it will terminate a long-standing alliance with China Eastern Airlines, although it will honour all existing bookings. The Australian Competition & Consumer Commission had signalled in September that it would oppose an application to extend the partnership. Qantas recently abandoned a $614m takeover bid for Alliance Aviation after the deal was opposed by the ACCC, while the competition watchdog is also pursuing legal action over allegations that Qantas had sold tickets for flights that it had already cancelled.

ACCC calls on banks in merger probe

The Australian Competition & Consumer Commission is currently assessing the ANZ Bank’s proposed deal to acquire Suncorp Group’s banking arm. Sources have indicated that the ACCC has requested information and data from the nation’s major and regional banks as part of the process, using its compulsory powers under the Competition and Consumer Act 2010. This information is said to include bank returns, net interest margins, funding costs and market share. The ACCC is seeking submissions on the ANZ deal by 18 January, and it aims to make a final decision on the transaction in June.

TPG could lift mobile prices despite block on sharing deal

Morningstar analyst Brian Han says the proposed regional mobile network sharing deal between TPG Telecom and Telstra is "not completely dead", given that both telcos intend to appeal the Australian Competition & Consumer Commission’s ruling. Amongst other things, the ACCC took the view that approving the deal would have given TPG an incentive to increase its mobile prices as soon as the network-sharing arrangement was completed. However, Eric Choi of Barrenjoey contends that TPG would have been likely to increase its mobile prices even if the ACCC had approved the deal. He notes that TPG is the only major telco that has not yet increased its consumer prices.

Uber faces $26m fine after ACCC probe

Ride-sharing pioneer Uber has admitted to breaching Australian consumer law by engaging in misleading or deceptive conduct and making false or misleading representations. The Australian Competition & Consumer Commission pursued action against Uber with regard to its algorithms, and Uber has agreed to penalties totalling $26m which must now be approved by the Federal Court.

Big tech faces tough new laws in ACCC plan

The Australian Competition and Consumer Commission is looking at what is known as ‘ex ante’ regulation as part of its plans to clamp down on the anti-competitive behaviour of big technology companies like Google and Apple. ‘Ex ante’ regulation involves banning certain anti-competitive behaviour before it happens, rather than after the event, and it already exists in the telecommunications and electricity sectors. The US, Britain and Japan are among a number of jurisdictions looking at ‘ex ante’ regulation of large technology companies, while Jacqueline Downes from law firm Allens says laws banning certain tech industry practices would be easier and quicker to enforce than current competition laws, which she says can be slow to prosecute.

NAB eyes Citi’s retail in $2b deal

National Australia Bank has emerged as a potential buyer of Citigroup’s local consumer banking business. NAB has advised that it is holding talks with Citigroup but stresses that a deal may not eventuate. Citigroup has an 11 per cent share of Australia’s credit card market, making it the fifth-biggest player in the sector, while it holds $5.5bn worth of household deposits and some $6.6bn worth of home loans. Australian Competition & Consumer Commission chairman Rod Sims recently indicated that it would closely scrutinise any bid for the Citigroup assets by one of the nation’s major banks.

Competition policy sealed tech giants deal

The federal government’s news media bargaining code has already prompted Google to secure commercial deals with some media companies. Facebook in turn has signed a letter of intent with Seven West Media and is negotiating with other news publishers. Communications Minister Paul Fletcher says there has been "significant overseas interest" in the approach the government took in treating the code as an issue of competition policy rather than copyright law. He adds that the code provided the leverage needed to ensure a level playing field between traditional media and digital platforms.

Facebook will be loser if it bans news: Sims

Facebook and Google would be forced to pay for news content that is posted on their platforms under the mandatory code of conduct proposed by the Australian Competition & Consumer Commission. Facebook has threatened to ban all news on its platform in response to the code, but ACCC chairman Rod Sims contends that such action could weaken the social media company. Sims has also rejected claims made in public campaigns by Facebook and Google that the proposed code will give news publishers access to their algorithms.
