ACCC to investigate advertising secrets of Google and Facebook

Australian Competition & Consumer Commission chairman Rod Sims is confident that it has sufficient powers to investigate the market power of digital platforms such as Google and Facebook. He says the ACCC’s inquiry into the impact of digital platforms on competition in media and advertising markets is likely to take around 18 months, with the Federal Government to receive a preliminary report on its findings within 12 months. Sims adds that the ACCC will seek input from all parties affected by the growing market dominance of digital players.

Google, Facebook face ACCC inquiry

The Australian Competition & Consumer Commission will hold an inquiry into the impact of digital platforms such as Google and Facebook on competition in the media and advertising sectors. The inquiry has been ordered by the Federal Government as part of its deal with former senator Nick Xenophon regarding media reforms. The inquiry’s terms of reference include examining digital platforms’ market power and their impact on the level of choice and quality of news and journalistic content. The ACCC’s final report is slated to be completed within 18 months.

Tabcorp-Tatts merger up in air as court orders new competition hearing

The Australian Competition Tribunal will reassess the proposed merger between Tabcorp and Tatts Group after the Federal Court upheld an appeal against its decision to approve the deal. However, the court has placed a five-day embargo on disclosing its reasons for ruling in favour of the Australian Competition & Consumer Commission, which will give the competition regular limited time to prepare a new submission on the $A11bn merger. The ACCC had argued that several points of law regarding the merger needed to be clarified.

Australian Competition & Consumer Commission chairman Rod Sims says it has a "neutral" position on the issue of mergers between the nation’s four major banks. However, the ACCC has used its submission to the Productivity Commission’s inquiry into competition in the financial system to urge it to examine the impact of the so-called "four pillars" policy. The ACCC has also asked the inquiry to consider whether the four pillars policy should be expanded to include smaller banks.

Watchdog slams AGL on Liddell

The Australian Competition & Consumer Commission had opposed the sale of Macquarie Generation – which owned the Liddell and Bayswater power stations – to AGL Energy in 2014. ACCC chairman Rod Sims believes that the $A1.5bn deal has contributed to the rising cost of electricity, noting that the competition regulator had warned of this at the time. AGL is under growing scrutiny over its plans to shut down the Liddell power station in 2022. The Federal Government recently set a deadline of 90 days for AGL develop a plan to replace the ageing plant’s output of 1,000 megawatts.

The Australian Competition & Consumer Commission recently indicated that it would not oppose the acquisition of Ten Network by Lachlan Murdoch and Bruce Gordon. However, ACCC chairman Rod Sims said a similar deal to acquire Seven or Nine may not necessarily have been approved, given that their news bulletins have higher ratings than Ten. Media industry sources also suggest that any bid by News Corp to acquire one of Ten’s rivals would be blocked on competition grounds.

Ten’s fate hinges on reform of media law

The Australian Competition & Consumer Commission has ruled that the acquisition of Ten Network by Lachlan Murdoch and Bruce Gordon would not result in a substantial lessening of competition. The ACCC took into account factors such as the growing use of streaming video-on-demand services and competition from rival free-to-air networks. However, Murdoch and Gordon cannot acquire Ten without cross-media ownership law reforms, although one option may be for them to each have a low voting stake in Ten but a high economic interest in the network.

BP issues price vow in bid to win Woolies deal

The Australian Competition & Consumer Commission is concerned that BP is not as competitive as Woolworths when it comes to fuel pricing. The ACCC is considering BP’s proposed $A1.8 billion purchase of Woolworth’s petrol stations, which was announced at the end of 2016. If the deal goes ahead, it would make BP the largest fuel retailer and wholesaler in Australia. BP Australia president Andy Holmes says it is keen to work with the ACCC to address any concerns it may have about the transaction.

Sims urges energy price competition

He cites factors such as appeals against the Australian Energy Regulator’s decision to reduce electricity network tariffs, mergers between electricity retailers and generators, and high solar feed-in-tariffs. Sims has also called for measures to curb the market dominance of established electricity retailers, such as making it easier for more companies to enter the market.

Tatts takeover at risk of delay, says Tabcorp

Tabcorp has advised shareholders that a court challenge should not affect its timetable to complete an $A11bn merger with Tatts Group. The wagering giant still expects the deal to be completed during the December 2017 quarter, despite a move by the Australian Competition & Consumer Commission to seek a judicial review of the Competition Tribunal’s decision to approve the merger. Tabcorp has indicated that it will push for an expedited hearing of the ACCC’s application to the Federal Court.
