The Australian Government will press ahead with legislation to reinstate the Australian Building & Construction Commission (ABCC). The bill was narrowly defeated in the Senate in August 2015, while a bill to impose criminal sanctions on officials of registered organisations such as unions was also rejected by the Senate. Employment Minister Michaelia Cash says the proposed merger between the Construction, Forestry, Mining & Energy Union and the Maritime Union of Australia highlights the need to reinstate the ABCC.

Fair Work Building & Construction’s 2015 annual report highlights the Australian construction industry’s lack of compliance with industrial relations laws. The report shows that Construction, Forestry, Mining & ­Energy Union officials were responsible for most of the 948 breaches of workplace laws that were investigated by the Fair Work Building ­Industry Inspectorate in 2014-15. The complaints investigated by the agency included coercion, unlawful industrial action, and breach of laws governing freedom of association and right of entry.

Frydenberg makes fresh pitch for IR reform

Australia’s Resources Minister Josh Frydenberg has weighed into the debate on industrial relations reform, arguing that weekend penalty rates cost jobs. He notes that the penalty rates system results in significantly increased costs in the resources sector. Frydenberg has also called for the reinstatement of the Australian Building & Construction Commission.

Boral lobbies senators for ABCC

Boral CEO Mike Kane has met with Senate crossbenchers to persuade them to support the legislation that reinstates the Australian Building & Construction Commission (ABCC). The Senate will vote on the ABCC bill in mid-August 2015. Australian Mines & Metals Association CEO Steve Knott urged crossbenchers to support the bill.

Abbott lines up double-D unions poll

The Australian Government plans to use the Registered Organisations Commission Bill as one of two potential triggers for a double-dissolution election. Officials of unions and employers’ groups who are found to be corrupt will be subject to the penalties that currently apply to corporate executives. The Government will also reintroduce its bill on the Australian Building & Construction Commission to the Senate when parliament resumes in August 2015.

The Australian Government faces resistance from the Opposition and the Australian Greens to extend these powers.
