A spokesman for Victorian International Container Terminal says the company is likely to seek costs against the Maritime Union of Australia after a court dismissed a challenge to its enterprise agreement. The legal challenge was mounted by dock worker Richard Lunt, but the Federal Court’s Justice Darryl Rangiah ruled that he was a ‘front man’ for the MUA, and that the case was an abuse of process. VICT’s Webb Dock terminal in Melbourne was unlawfully picketed by the MUA in late 2017.

Docks strike not an anniversary walkout

The Maritime Union of Australia has defended its decision to launch industrial action at Melbourne’s Webb Dock. The MUA attributes the four-day strike to Qube’s refusal to reinstate a 2014 roster whereby employees worked for seven weeks and had one week off. Qube argues that this roster is uneconomic, and it wants the Fair Work Commission to terminates an existing enterprise agreement. The MUA has rejected suggestions that the strike is timed to coincide with the 20th anniversary of the 1998 waterfront dispute.

Melbourne ports dispute set to escalate

Qube Ports wants the Fair Work Commission to terminate an enterprise agreement for dock workers in Melbourne, but the Maritime Union of Australia has warned of further industrial action if Qube succeeds. Workers at Qube’s terminal in Melbourne have staged a 48-hour strike and imposed work bans, and the MUA’s Warren Smith says workers will not return to work if the FWC terminates the enterprise agreement. Qube has rejected the MUA’s push to reinstate a 2014 roster whereby employees worked for seven weeks and had one week off, arguing that it is uneconomic.

Union leader ordered to halt illegal Port of Melbourne picket

Victorian Trades Hall secretary Luke Hilakari and union officials will be barred from blockading Victorian International Container Terminal’s site at Webb Dock. VICT CEO Andres Dommestrup has welcomed the Supreme Court’s decision to grant injunctions against Hilakari, the Construction, Forestry, Mining & Energy Union and the Maritime Union of Australia. VICT had claimed that Hilakari had been the leader of picketers who have blocked access to the company’s Webb Dock facility for several weeks.

Conspiracy claim over docks dispute

Victorian International Container Terminal (VICT) has told the Supreme Court that an ongoing blockade of its Webb Dock terminal is doing "immeasurable" harm to its business. VICT has alleged that Trades Hall secretary Luke Hilakari and other unionists are involved in a conspiracy against the company, and is seeking an ongoing injunction against Hilakari and the Maritime Union of Australia. Justice Michael McDonald said the ongoing blockade is an example of "plainly unlawful conduct".

Unions block docks with cars, share bikes

Maritime Union of Australia supporters are defying a court order to end a picket of Victorian International Container Terminal at Webb Dock in Melbourne. Trucks are being prevented from accessing the site, with roads being blocked with a range of objects. The blockade has been in place since late November, preventing access to more than 1,000 shipping containers of consumer goods and medical supplies. The dispute arose after the MUA alleged that VICT refused to provide one of its members with shifts at the site. VICT contends that the worker does not have a maritime security identification card.

Port operator to sue MUA over illegal picket line

Victoria International Container Terminals is planning legal action against the Maritime Union of Australia over what it claims is an illegal picket at Melbourne’s Webb Dock terminal. The picket has been in place since 27 November, and is aimed at pressuring VICT to re-deploy a stevedore who was denied a security clearance that would allow him to work in the dock’s restricted zone. VICT contends the MUA’s action puts at risk business growth in the order of $A100 million.

Record $9.7b port sale rides boom

The Victorian Government had expected to gain between $A5bn and $A7bn from the privatisation of the Port of Melbourne. The $A9.7bn deal with the Lonsdale Consortium reflects an EBITDA multiple of 25 times earnings, while the State Government will also receive a payment of $A1.45bn from its federal counterpart under the asset-recycling scheme. Proceeds of the sale of the port’s 50-year lease will be reinvested in road and rail infrastructure, including the Government’s level crossing removal program.

Hutchison in bid to end ports duopoly
