AMP admits dirty deeds and deceptions

Shares in AMP fell sharply on 17 April after the banking royal commission heard further revelations of misconduct. Jack Regan, AMP’s head of financial advice, told the inquiry of multiple instance in which AMP had misled the Australian Securities & Investments Commission with regard to an investigation into a financial planning scandal. Amongst other things, the inquiry was told that AMP had falsely informed clients that they had been overcharged. Regan also said AMP’s relationship with Clayton Utz raised questions about the impartiality of the law firm’s investigation into the scandal.

New chief Comyn pledges to restore confidence in CBA

Commonwealth Bank of Australia CEO Matt Comyn has told staff that he is committed to changing the culture at the bank in the wake of a series of scandals. Comyn conceded that CBA had not done enough to protect the interests of its customers, and apologised for the mistakes made by himself and other top executives. Brett Le Mesurier of Shaw & Partners says acting on the recommendations of the banking royal commission will be a key challenge for Comyn, who formally succeeded Ian Narev as CEO on 9 April.

APRA targets banker bonuses

A review of remuneration in the banking, insurance and superannuation industry shows that senior executives are rarely penalised financially for poor risk management practices or misconduct among staff within their purview. Wayne Byers, the chairman of the Australian Prudential Regulation Authority – which undertook the review – says bank executives should be held more accountable, calling for their bonuses to be deferred or forgone. Frank Mirenzi of Moody’s Investors Service notes that many countries have cracked down on executive pay in the banking sector in the wake of the global financial crisis.

Lib MP growls over layer of BEAR red tape

The Greens will seek amendments to the Federal Government’s Banking Executive Accountability Regime in the Senate, after the legislation was passed by the lower house on 5 February. Liberal MP Nicolle Flint opposed the BEAR regime, arguing that it will further increase the compliance burden for the financial sector, noting that it has been subject to a spate of new rules and regulations in recent years. The BEAR regime, which is slated to take effect in July, has the support of the Australian Labor Party.

Harvey Norman showdown likely over chairman’s re-election

The Australian Shareholders’ Association has urged Harvey Norman shareholders not to vote for the re-election of chairman Gerry Harvey and two other directors at its AGM on 16 November. If the nominated three directors are re-elected, the ASA contends Harvey Norman will no longer have an independent board as from December. Under its guidelines, any director that has been on a board for more than 12 years is no longer deemed independent. The ASA also plans to vote against Harvey Norman’s remuneration report, while it will also urge Wesfarmers’ shareholders to vote against its remuneration report at its AGM, to be held on the same day.

APRA probe risks CBA rating

The Australian Prudential Regulation Authority will establish an independent panel to review the Commonwealth Bank of Australia’s governance, culture and accountability. CBA CEO Ian Narev has described the review, which follows a series of scandals at the nation’s largest bank, as a "positive and constructive step". However, ratings agencies S&P Global and Fitch have warned that CBA’s credit rating could be downgraded if the review results in any adverse findings. Shadow treasurer Chris Bowen maintains that a royal commission into the entire banking sector is needed.

Rumour mill picks candidates to replace Narev

Brian Johnson of CLSA says the Commonwealth Bank of Australia may need to select an external candidate to succeed CEO Ian Narev, as the money-laundering scandal has tainted internal contenders. Matt Comyn and Rob Jesudason were widely regarded as leading candidates from within CBA’s ranks prior to the scandal. Former Westpac executive Rob Whitfield, Royal Bank of Scotland CEO Ross McEwan and Medibank CEO Craig Drummond are seen as potential external candidates to replace Narev when he steps down by mid-2018.

Livingstone ousts CEO Narev, cuts pay, puts execs on notice

The Commonwealth Bank of Australia’s board has reiterated its intention to take further action on cuts and changes to executive pay and incentives in the wake of the money laundering crisis. Its actions come as it announced that CEO Ian Narev will retire by 30 June 2018, with his successor most likely to be an external appointment. Louise Davidson, the CEO of the Australian Council of Superannuation Investors, says there are clearly some problems with the CBA’s culture, noting its recent problems involving financial planning and life insurance.

CBA chiefs facing more salary pain

The Commonwealth Bank of Australia could announce further cuts to executive pay and incentives in the wake of the money laundering crisis. Its actions could extend to executives who are no longer with the bank but were working for it when the suspicious ATM transactions that led to AUSTRAC’s actions occurred. Alden Toevs, the CBA’s chief risk officer from 2008 to 2016, could potentially lose his rights to CBA shares, as could former chief financial officer David Craig.
