Thousands ‘opting out’ of AWU

The Royal Commission into Trade Union Governance & Corruption has identified some disturbing practices at labour unions. Jeremy Stoljar, counsel assisting the commission, states in a submission released on 6 November 2015 that some employers paid membership fees to the Australian Workers’ Union in Victoria on behalf of "phantom members" who did not exist or were automatically signed up to the union without their knowledge.

Employers face criminal action over AWU

Jeremy Stoljar has concluded that federal Opposition Leader Bill Shorten was not involved in criminal or unlawful conduct when he was head of the Australian Workers’ Union (AWU). However, the counsel assisting the Royal Commission into Trade Union Governance & Corruption has recommended that commissioner Dyson Heydon should conclude in his findings that former AWU boss Cesar Melhem and several companies may have contravened the Crimes Act regarding payments to the union.

The funds of yet another union have been misused by corrupt officials. Danielle O’Brien, former account manager at the National Union of Workers, admitted that she used union funds for personal purposes. The Royal Commission into Trade Union Governance & Corruption has been told that $A68,395 in total was transferred from the union’s accounts to personal accounts controlled by O’Brien between July 2011 and June 2015.

Denials wear thin as evidence mounts

Melbourne’s EastLink tollroad project was finished well ahead of schedule, but evidence presented to the trade union royal commission demonstrates that industrial peace came at a cost. Julian Rzesniowiecki was a senior executive at Thiess John Holland, who kept records showing that the Australian Workers’ Union had proposed that Thiess pay $A300,000 for one union organiser to be on site. The proposal was put forward by current Opposition Leader Bill Shorten in his capacity as head of the AWU. He had initially proposed that Thiess pay for four AWU members to be on site for the life of the project.

The Royal Commission into Trade Union Governance & Corruption will hear further evidence concerning the Australian Workers’ Union in the week beginning 12 October 2015. However, Opposition Leader Bill Shorten is not expected to be asked to front the inquiry again, as there have been no applications to cross-examine the former AWU national secretary. Shorten has been highly critical of the royal commission.

The activities of the Australian Workers’ Union will come under further scrutiny by the Royal Commission into Trade Union Governance & Corruption. Royal commissioner Dyson Heydon has indicated that Federal Opposition Leader Bill Shorten – a former national secretary of the AWU – will not be required to appear before the inquiry again at this stage, but he has not ruled out asking Shorten to do so if this is deemed necessary.

It has been revealed that Dave Hanna stepped down as national president of the Construction, Forestry, Mining & Energy Union after being linked to payments made by two subcontractors to finance IVF treatment for the partner of a union organiser. Hanna resigned in August 2015, and he is the subject of an investigation by the Royal Commission into Trade Union Governance & Corruption over an unrelated matter. He had cited health issues as the reason for his resignation.

Cbus CEO David Atkin has been accused of being likely involved in the leaking of confidential information to the construction industry union. Jeremy Stoljar, counsel assisting the Royal Commission into Trade Union Governance & Corruption, also stated in a submission to royal commissioner Dyson Heydon that the relationship of Cbus with the Construction, Forestry, Mining & Energy Union was problematic and characterised by "serious cultural problems."

Union leaders fighting the Royal Commission into Trade Union Governance & Corruption have been likened to corrupt police who tried to shut down the Fitzgerald Royal Commission in Queensland in the 1980s. Attorney-General George Brandis said the Australian Labor Party and the unions were throwing mud at the royal commission because they had much to fear. The head of the royal commission, Justice Dyson Heydon, has refused to recuse himself.

The Canberra offices of the militant Construction, Forestry, Mining & Energy Union (CFMEU) have been raided by Australian Federal Police, who seized computers as part of an extortion investigation. It follows evidence at the Royal Commission into Trade Union Governance & Corruption and the arrest of two CFMEU officials. Meanwhile, the Victorian Supreme Court heard claims that Boral was told it should pay Mick Gatto $A100,000 to mediate its dispute with the union.
