Lawyer flags Frydenberg eligibility challenge

Treasurer Josh Frydenberg says the Coalition is confident that all of its MPs are eligible to be in parliament. However, the Kooyong Independents Group is said to be planning to challenge the citizenship status of Frydenberg, arguing that he is a Hungarian citizen by descent. The Kooyong Independents Group is associated with Oliver Yates, who contested Frydenberg’s seat of Kooyong at the 18 May election.

Dual citizenship crisis could have been avoided

Former attorney-general Daryl Williams proposed changes to section 44 of the Constitution in 1997 which would have avoided the need for MPs to resign in recent years due to their dual citizenship status. The National Archives has released cabinet papers which show that the Coalition government was open to holding a referendum on the issue if it had bipartisan support in parliament. The total cost of by-elections and legal bills arising from the dual citizenship crisis is tipped to exceed $24m.

Dismay as candidates snub dual-citizenship checklist

New voluntary checklists aimed at assuring voters that political candidates are eligible under Australian citizenship laws were introduced in the wake of the dual-citizenship fiasco. It has been revealed that of the 48 candidates taking part in five upcoming by-elections, 17 have either not completed the checklist or chosen not to have the details made public. Constitutional law expert Anne Twomey says electors may decide not to vote for candidates who have decided not to fully participate in the checklist process.

Cloud hovers over Labor’s Aly

The dual citizenship saga continues to plague Federal Parliament, with the latest High Court ruling having raised uncertainty about the eligibility of Labor MP Anne Aly. Parliament’s citizenship registry shows that Aly applied to have her Egyptian citizenship cancelled in early May 2016, well before nominations for the federal election closed in June. However, Aly is yet to submit any documentation to prove that her Egyptian citizenship has been cancelled. Professor George Williams from the University of New South Wales has called for a referendum on the issue of dual citizenship.

Call for referendum on dual citizenship

Professor Kim Rubenstein of the Australian National University says the High Court’s latest ruling on dual citizenship demonstrates the need for a referendum on section 44 of the Constitution. She says that only a "small pool" of Australians will be eligible to be in parliament unless section 44 is amended. A parliamentary inquiry is examining the question of whether changes to the Constitution are necessary, and it is slated to report its findings in coming days.

Shorten to face leadership test

Labor MPs Susan Lamb, Justine Keay and Josh Wilson have resigned from parliament after the High Court ruled that Labor senator Katy Gallagher is disqualified due to dual citizenship. The eligibility of the three MPs, as well as Centre Alliance MP Rebekha Sharkie – who has also resigned – had also been uncertain. Senior officials of both the Liberal and Labor parties concede that the outcome of the resulting by-elections could put pressure on the leadership of both Prime Minister Malcolm Turnbull and Opposition Leader Bill Shorten. The four lower house by-elections are expected to be held on the same day.

Labor bracing for mid-year byelections

The High Court will hand down its determination on whether Labor senator Katy Gallagher is eligible to sit in parliament because of her dual citizenship on 9 May. Should its decision go against her, there would be pressure on fellow Labor MPs Susan Lamb, Justine Keay and Josh Wilson and Centre Alliance MP Rebekha Sharkie to resign from parliament or be referred to the High Court. Should Lamb, Keay and Wilson resign, it is likely that by-elections would be held on the same day as the one to replace Labor MP Tim Hammond, who resigned in early May.

PM seeks more scalps as Labor refers duals

The High Court will determine whether Australian Labor Party MPs David Feeney and Katy Gallagher are eligible to be in federal parliament due to dual citizenship concerns. Labor advised on 6 December that it will refer the matter to the court, and it is facing growing pressure over three of its other MPs. The Federal Government is seeking the support of crossbenchers in the lower house to also refer Justine Keay, Susan Lamb and Josh Wilson to the court. Labor in turn believes that a number of Coalition MPs should be referred to the High Court.

Dual-citizenship debacle catches up with Shorten

Documents released on 4 December reveal that Labor Senator Katy Gallagher remained a UK citizen two months after nominations for the 2016 federal election closed. National Party leader Barnaby Joyce, who had to re-contest the seat of New England after being forced to resign over his dual citizenship, has accused Opposition Leader Bill Shorten of being a big hypocrite over the issue. Joyce noted that Shorten had claimed that no Labor MP would become embroiled in the dual-citizenship saga.

NXT senator steps down over dual citizenship

Nick Xenophon Team senator Skye Kakoschke-Moore has become the latest federal politician to become caught up in the dual-citizenship saga. Kakoschke-Moore announced her resignation from the Senate on 22 November, after discovering she had inherited dual UK citizenship through her mother. She asked that the Senate refer her case to the High Court when it resumes sitting in the week beginning 27 November.
