Union vows to sue after blackmail case folds

Victoria’s Director of Public Prosecutions will not proceed with a blackmail case against Construction, Forestry, Mining & Energy Union officials John Setka and Shaun Reardon. Setka has indicated that he may pursue legal action against federal and state police, as well as law firm Freehills. The case against Setka and Reardon had centred on allegations that their threat to blockade Boral trucks in 2013 constituted blackmail. The CFMEU was engaged in an industrial dispute with Boral supplier Grocon at the time. The charges against Setka and Reardon had been recommended by the trade union royal commission.

CFMEU’s Setka to fight charge

The Supreme Court of Victoria has ruled that criminal charges of blackmail laid against two Construction, Forestry, Mining & Energy Union officials should proceed. The CFMEU had sought to have the charges deemed invalid on the grounds that the alleged blackmail occurred during an industrial dispute. The charges against CFMEU Victorian secretary John Setka and his deputy Shaun Reardon relate to allegations of blackmail against two Boral executives in 2013. The CFMEU is expected to appeal against the court’s ruling.

Five legal battles to watch in 2016

Some high-profile legal disputes in the Australian property sector will be contested in court during 2016. A tenancy dispute between Roy Morgan Research and Impact Investment Group will return to court in February. The Gary Morgan-led market research firm was briefly locked out of its offices in Melbourne’s Collins Street in late December 2015, before a court ordered Impact to grant access to the building. Construction, Forestry, Mining & Energy Union officials John Setka and Shaun Reardon will defend blackmail charges arising from an industrial dispute with Grocon that subsequently embroiled Boral. Sunland Group faces a damages claim by former employee Marcus Lee, while litigation is continuing between Grocon and APN Property Group.

CFMEU officials charged with blackmail against Boral

Construction, Forestry, Mining & Energy Union officials John Setka and Shaun Reardon will appear in the Melbourne Magistrates’ Court on 8 December 2015. They face potential jail sentences of up to 15 years after Victorian police charged them with blackmail. The charges relate to an industrial dispute with Grocon, which resulted in building materials group Boral being subject to black bans. It will be alleged that Setka threatened to escalate the bans on Boral unless it ceased supplying cement to Grocon.

Senior CFMEU bosses face criminal charges

Officials of the militant Construction, Forestry, Mining & Energy Union (CFMEU) are under police investigation in three states. National president Dave Hanna, who was also a vice-president of the Australian Labor Party in Queensland, has quit the union as police probe allegations that he received secret commissions. In Victoria, senior officials of the CFMEU’s construction division are facing allegations of blackmail, while in New South Wales Brian Parker, the state secretary, is being investigated after phone taps linked him to organised crime figure George Alex.
