Three lawsuits looming for AMP

AMP has declined to comment on reports that it may face multiple class action lawsuits after the misconduct of its financial planners was exposed by the banking royal commission. Slater & Gordon and Shine Lawyers have advised that they are considering class actions on behalf of AMP clients, while Quinn Emanuel Urquhart & Sullivan expects to launch its own class action within weeks. Meanwhile, the inquiry has been told that many clients who received poor financial advice from AMP have yet to be informed that they have lost money.

AMP admits to misleading ASIC 10 times

AMP confessed to the banking royal commission on 16 April that it had misled the Australian Securities & Investments Commission on at least 10 occasions. Its deception related to a scheme that saw numerous customers charged fees for services they did not receive. With financial planning being the focus of the banking royal commission’s second round of public hearings, ASIC deputy chair Peter Kell said that in his opinion financial planners should not be able to refer to themselves as professionals, such has been their poor behaviour in recent years.

Banks discuss new standards council option

The second week of the banking royal commission’s public hearings will commence on 16 April, with financial planning to be the initial focus. AMP executive Anthony Jack Regan and Australian Securities & Investments Commission deputy chairman Peter Kell are both expected to appear before the commission on 16 April. Meanwhile, talks involving the formation of a Professional Banking Council are continuing, with banks, regulators and industry associations involved in the discussions.

Financial advice will be the focus of the banking royal commission’s second round of public hearings, which will commence on 9 April. While the four major banks are likely to attract further scrutiny, AMP and its subsidiaries have also been asked to appear before the inquiry, along with officials from the Australian Securities & Investments Commission and industry bodies such as the Financial Planning Association of Australia and the Association of Financial Advisers.

Opportunity for financial planners to gain trust

The new 2017 edition of the Roy Morgan "Superannuation & Wealth Management in Australia" report has found financial planners need to gain a greater level of trust among Australians. Trust in financial planners for ethics and honestly has shown no real improvement since the survey began in 2009, declining by 2% points in the past 12 months to 25%, back to the 2009 level. The report suggests ongoing confusion about which financial planners offer independent advice may have a part to play in this issue. Despite low trust in the industry, those who purchase their superannuation through an independent financial planner/adviser are the most satisfied (71.3%). The next most satisfied group are those who purchased through an accountant, with a satisfaction level of 68.8% in the latest 12-month period.

Banks take advantage and profit from ‘general advice’

Financial Planning Association CEO Dante De Gori has expressed concern about the use of the term "general advice" in Australia’s financial services industry. He argues that many consumers are confused about what constitutes financial advice. The FPA advocates changing the phrase "general advice" to "general information", to ensure that consumers understand that they are being sold a financial product rather than receiving financial advice.

NAB pays out $6.5m for poor advice

National Australia Bank has revealed that it paid $A6.5 million in compensation to customers who received poor financial advice over the past 18 months. NAB’s head of consumer banking and wealth management, Andrew Hagger, said a significant investment had been made in the bank’s complaints resolution system. The Commonwealth Bank has stated that a third of its compensation scheme was completed in June 2016.

Bank of Qld hit with second class action

Law firm Quinn Emanuel Urquhart & Sullivan has launched legal action against Bank of Queensland, alleging that the bank "knowingly assisted" Sherwin Financial Planners in distributing-Ponzi-like products. The law firm is representing investors in the Petersen Superannuation Fund who invested in Money Market Deposit Accounts offered by Sherwin Financial Planners.

ASIC used legal powers to extract NAB information

The corporate regulator is reviewing compensation paid to clients of National Australia Bank who received inappropriate financial advice. Greg Medcraft, the chairman of the Australian Securities & Investments Commission, said on 25 February 2015 that the regulator asked the bank for more information about compensation. The bank paid between $A10 million and $A15 million to aggrieved customers

All in four days’ work for CBA’s planners

In response to the recent scandal involving flawed advice by its financial planners, Commonwealth Bank of Australia has announced new minimum requirements for these staff. While newly hired planners will need to have relevant university degrees, the existing 1,500 to 2,000 employees are obliged to merely obtain an Advanced ­Diploma in Financial Planning. This can be gained with the equivalent of just four days’ worth of work and no exams, and the planners will have until mid-2017 to qualify
