ABCC bill could shut out companies

The Federal Government will not back down on its plan to make a national building code retrospective as part of its legislation to reinstate the Australian Building & Construction Commission. The code will apply to all enterprise agreements that have been made since 2014, and compliance with the code will be a condition of being granted federal construction contracts. However, some pattern bargaining agreements struck by the Construction, Forestry, Mining & Energy Union and the Electrical Trades Union in Victoria and Queensland would not comply with the proposed code.

ABCC bill passes House of Reps

The Federal Government’s bill to reinstate the Australian Building & Construction Commission was passed by the House of Representatives on 18 October 2016. The Government is negotiating with crossbenchers to pass the bill in the Senate. Meanwhile, Prime Minister Malcolm Turnbull says the ABCC bill and the registered organisations bill are aimed at boosting the economy rather than targeting unions. However, Coalition backbench MP Andrew Laming has questioned whether unions are still necessary.

Senate rides shotgun on IR bills

The Australian Government is hopeful that all but one senate crossbencher, Jacqui Lambie, will be open to supporting its bills to reinstate the Australian Building & Construction Commission and establish a Registered Organisations Commission. However, some crossbenchers have a list of policies they want implemented in return for their support. Amongst other things, Nick Xenophon will press for imported building materials to be subject to local building standards and increased protection for whistleblowers, while David Leyonhjelm wants importation of the seven-shot Adler shotgun to be legalised.

They include industrial relations reform, corporate tax cuts, superannuation tax reform and changes to competition law. Turnbull says he is "quietly confident" that the Senate will pass bills to reinstate the Australian Building & Construction Commission and establish the Registered Organisations Commission, and he may be open to compromise deals in order to ensure their passage.

Howard urges PM on tax, IR reform

Meanwhile, Treasurer Scott Morrison says the government has had "constructive" talks with the Opposition regarding Budget savings measures.

Senate count favours ABCC bill

The Federal Government’s chances of getting its Australian Building & Construction Commission legislation passed by a joint sitting of Parliament have been bolstered after the Liberal Party’s Jane Hume won the final Senate seat in Victoria. The Government needs 114 votes in a joint sitting, and it will commence negotiations with crossbenchers to support the bill. The final two Senate seats are expected to be decided shortly.

Workplace laws rigid and out of date: report

Reforms are need in Australia’s employment laws in order to reflect the changing nature of work. Industrial relations expert Stephen Sasse states in a report written for the Institute of Public Affairs that flaws in the current employment system include rigidity, excessive interference from regulatory bodies and disregard for the efficacy of market forces. The report is titled "Your Right to Work".

Games site hostage to union ‘ploy’

The Federal Court has been told that stopwork action at a key 2018 Commonwealth Games construction site was unlawful and unconscionable. Fair Work Building & Construction claims that the industrial action by the Construction, Forestry, Mining & Energy Union was designed to get lead contractor Hansen Yuncken to accept a new enterprise bargaining agreement. The CFMEU says the two-hour stopwork meetings – which were held twice a day – were needed to inform workers about the Coalition’s proposed industrial relations reforms in the lead-up to the federal election.

Turnbull throws down the gauntlet on IR reform

The Fair Work Commission is tipped to announce the outcome of its review of weekend penalty rates in sectors such as hospitality and retail in September 2016. Prime Minister Malcolm Turnbull has indicated that the Federal Government will abide by the FWC’s decision and will not intervene, despite being urged by Opposition Leader Bill Shorten to make a joint submission to the review. Turnbull in turn has called on Shorten to support proposed legislation to outlaw the payment of "corrupting benefits" by employers to unions in return for surrendering employee entitlements such as penalty rates.

The reintroduction of legislation to reinstate the Australian Building & Construction Commission will be one of the Federal Government’s priorities when parliament resumes. However, at best the Coalition is likely to have 79 seats in the lower house and 29 in the Senate, which means it would need the support of at least five crossbenchers if the ABCC bill is put before a joint sitting of parliament.
