Fortescue is being represented by Julian Cooke SC in its intellectual property dispute with ‘green iron’ start-up Element Zero. The company was founded by former Fortescue employees Bart Kolodziejczyk, Bjorn Winther-Jensen and Michael Masterman, allegedly using the iron ore miner’s intellectual property. Cooke has defenced Fortescue’s use of a private investigator to place the three executives and their families under surveillance, telling the Federal Court that there was a real risk that information pertaining to the pending court case could have been destroyed. The surveillance operation was followed by raids on the homes and business premises of the Element Zero directors

Fortescue ‘portrayed former execs as dishonest’, court told

Element Zero is seeking to have search orders awarded to Fortescue in May by Federal Court judge Melissa Perry thrown out; Parry granted the orders on the back of allegations that former Fortescue executives who are now directors of Element Zero had stolen Fortescue’s intellectual property. In trying to convince Federal Court judge Brigitte Markovic that the orders granted by Parry should be thrown out, the Element Zero directors told the court on Monday that Fortescue had sought to portray them as ‘shady actors’ who were seeking to steal its ‘green iron secrets’ so as to justify its request for the orders, which saw it raid their homes and offices.

Allens calls for copyright rejig to meet AI age

Andrew Wiseman of law firm Allens has called for an overhaul of Australia’s copyright laws to provide protection for original material that has been generated by artificial intelligence systems. He argues that other countries are addressing the issue of the copyright status of such works, and that it is regularly discussed at international conferences. However, John Fairburn of Minter Ellison cautions against acting too quickly without fully considering the issue.

Domino’s in David & Goliath battle over GPS

Domino’s Pizza Enterprises is the subject of legal action by Sydney IT company Precision Tracking. The latter has accused Domino’s of infringing its patents, and is seeking an injunction to prevent Domino’s from continuing to use its GPS Driver Tracker system, as well as seeking damages. Precision Tracking contends Domino’s system is based on its GPS technology. Litigation Capital Management is helping to finance Precision Tracking’s action against Domino’s. Precision Tracking claims it and Domino’s were involved in a partnership to develop its technology, but that the pizza maker reneged on their arrangement. Domino’s is counter-suing Precision Tracking and its three directors.

Packer doesn’t want to share his Crown

The Federal Court will be asked to rule on the right to use the Crown brand and logo in a trademark dispute between James Packer and property developer Iwan Sunito. Packer’s Crown Resorts is seeking to have Crown Group Holdings barred from using trademarks such as Crown Apartments, Crown Towers and Crown Resort in marketing its apartment projects. The listed group is undertaking its own apartment project as part of the Crown Sydney hotel and casino development

Shares in IPH Limited have peaked at $A3.80 since debuting on the Australian sharemarket at $A2.10 in November 2014. IPH is the holding company for law firm Spruson & Ferguson, and its success has prompted other intellectual property and patent law firms to consider IPOs. Graham Cowin, the managing partner of Phillips Ormonde Fitzpatrick, says the firm is looking at a range of options, while Griffith Hack chairman David Hughes says his firm has ruled out in IPO at this stage
