The Maritime Union of Australia faces the likelihood of large civil penalties after the Federal Court found it had breached the Fair Work Act by taking unlawful industrial action. The action, which lasted for seven days in 2015, was prompted by the dismissal of 97 workers by Hutchison Ports Australia, with the MUA appearing to take the view that the dismissals were an attempt to reduce its influence over the Hutchison workforce. The legal action against the MUA was instigated by the Fair Work Commission. As well as the prospect of sizeable civil penalties, the MUA may also have to pay damages.
