CFMEU members have backed John Setka’s final deal as Victorian secretary of the union before his retirement. The deal with Master Builders Victoria provides for a 20 per cent increase in pay for construction workers over the next four years and reinstates conditions banned under the former Coalition government’s building code, including union flags on site and union vetoes on rostered days off. The deal is expected to be rolled out to the rest of the construction industry in coming weeks.

Melbourne’s train network may be hit by work bans and stoppages after about 99 per cent of Rail, Tram & Bus Union members voted to take industrial action over stalled negotiations regarding a new enterprise agreement. RTBU state secretary Luba Grigorovitch says the union has been holding talks with Metro Trains for five months, and members will try to minimise the impact of any disruption for commuters. The union is seeking a pay rise of six per cent for Metro’s operational staff, whose existing enterprise agreement expired at the start of July.

The Victorian division of the CFMEU and its officials were fined a total of $A1.12m by the Federal Court in 2017, while the state accounted for 36 per cent of court-imposed penalties across the nation. Meanwhile, the Australian Building & Construction Commission commenced 38 separate investigation into alleged breaches of workplace laws in the state’s construction industry during the year. This included 16 cases of alleged coercion of building firms and five breaches of laws regarding unions’ right of entry.

Victoria’s Country Fire Authority wants to halt a case in the Supreme Court. The case was launched by the Volunteer Fire Brigades Victoria, which argued that the CFA’s proposed enterprise agreement with the United Firefighters Union had a number of deficiencies. The CFA says the passage of the Federal Government’s CFA legislation makes the case irrelevant.

Flame out: Labor Left union brawl cost Shorten the election

The Australian Labor Party lost one Victorian seat in the 2016 federal election, although it had expected to win at least two. Party insiders downplay the impact that the Country Fire Authority dispute had on Labor’s federal election prospects, although Veterans’ Affairs Minister Dan Tehan says the dispute ensured that the Coalition was returned to office with a one-seat majority rather than the election resulting in a hung parliament. United Firefighters’ Union secretary Peter Marshall does not believe that the CFA dispute had any impact on the election result.

There is concern within the Australian Labor Party that the dispute over union control of Victoria’s Country Fire Authority may cost it the federal election. Labor must win 21 seats nationwide in order to win the election, but it now seems unlikely to win the Victorian marginal seats of Dunkley and Corangamite due to the CFA dispute. Some federal Labor MPs have criticised the handling of the dispute by Premier Daniel Andrews, with federal Opposition Leader Bill Shorten also expressing dissatisfaction with the state government’s actions.

Victorian Freedom of Information Commissioner Lynne Bertolini has sided with the Ambulance Employees Australia union, and ruled that Ambulance Victoria should make public data on its response times for patients suffering heart attacks. An appeal to the Victorian Civil & Administrative Tribunal is possible, and the deadline of 60 days means that the information will likely not become available until after the November 2014 state election

Public safety at risk over cardiac calls: Firefighters

The Fair Work Commission is hearing a dispute between the Metropolitan Fire Brigade and the United Firefighters Union in Victoria. The latter had during the 2013-14 summer argued that its members were not properly prepared to attend to cardiac arrest calls during a record heatwave. The MBF had wanted to roster an additional 30 staff, as 300 such emergencies were forecast. Firefighters accompany Ambulance Victoria paramedics to all incidents where patients have stopped breathing
