Seven West Media is unlikely to enforce a costs order against former employee Amber Harrison provided she complies with a non-disclosure agreement. The Supreme Court of New South Wales has ruled that Harrison must pay Seven’s legal costs on an indemnity basis. Justice John Sacker said that Seven had incurred
"unnecessary and significant legal costs" due to Harrison’s
"unreasonable" actions in pursuing legal action against the media group.

Voelte to pay ABC legal costs after defamation case fails

A jury has rejected a defamation lawsuit against the ABC over a news story that was broadcast on "The Business" in November 2014. Former Seven Group Holdings CEO Don Voelte had alleged that the story on Seven Group’s takeover of Nexus Energy was defamatory. The story claimed that the former Nexus chairman had "dudded" shareholders and that he had "switched camps". Voelte has been ordered to pay most of the public broadcaster’s legal costs.

Former investment banker Oliver Curtis could be jailed for up to five years after being convicted of conspiracy to commit insider trading. The Australian Securities & Investments Commission had alleged that he profited by using market-sensitive information to trade contracts for difference in 2007 and 2008. Curtis had used inside information supplied by co-conspirator John Hartman, an equities dealer at Orion Asset Management. Hartman has served a 15-month jail term, and received a reduced sentence for providing evidence against Curtis.

WIN loses streaming battle against Nine

The Supreme Court of New South Wales has dismissed WIN Corporation’s application for an injunction to stop Nine Entertainment Company from streaming its metropolitan TV channels into regional markets. Justice David Hammerschlag has ruled that live streaming does not constitute broadcasting under the parties’ affiliation agreement. WIN CEO Andrew Lancaster says the judgment demonstrates the need to scrap the "reach rule". The ruling may affect other regional broadcasters in negotiating new affiliation agreements.

SBS staffer convicted over drunken post

SBS employee Nicholas Hogan has been given a two-year good behaviour bond after being convicted of making threats to kill police officers. The Newton Local Court in Sydney found the editing assistant guilty on a charge of using a carriage service to menace, harass or offend. Hogan had posted a message on Facebook stating that he intended to kill a police officer in the name of Allah. The post was made one day after the funeral of police accountant Curtis Cheng, who was murdered by a Islamic extremist.

Rinehart sues for Hancock ‘falsehoods’

Australian billionaire Gina Rinehart is seeking damages from Nine Entertainment Company for alleged defamation. Rinehart says that 20 "glaring errors" were made in Nine’s two-part TV series "House of Hancock". Her claims, including that Nine committed the tort of injurious or malicious falsehood, were filed in the Supreme Court of New South Wales in late February 2015

NSW OSR takes action to wind up Jets over unpaid debts

The Supreme Court of New South Wales has ruled that the City of Sydney and the Carlton Crest Hotel must pay more than $A2.6m in damages over the death of a motorist. The deceased hit a metal barrier while reversing his car in a multi-storey car park, falling to his death. The court found that both defendants were negligent in allowing the car park to be used when it did not comply with safety standards

Former Ryde City Council mayor Ivan Petch wants the Supreme Court of New South Wales to overturn an Independent Commission Against Corruption (ICAC) ruling that he engaged in corrupt conduct. Amongst other things, ICAC found that he tried to improperly influence the council’s former manager and deliberately disclosed confidential information. Petch was suspended from the city council in mid-2014

New South Wales (NSW) Attorney-General Brad Hazzard is seeking to have serial litigant Tosson Mahmoud banned from launching any further cases without the express consent of the courts, drawing on the Vexatious Proceedings Act. The matter will be heard on 9 March 2015, and in October 2014 Mahmoud has applied to have Supreme Court of NSW judge Monika Schmidt excuse herself. He argues she will be biased against him due to his well-known views on women in positions of authority. Schmidt has rebuffed the move
