The Supreme Court of Queensland has ruled that the state government’s COVID-19 vaccine mandate for frontline workers such as police officers and paramedics was unlawful. More than 70 such workers pursued legal action against the government, contending amongst other things that requiring them to be vaccinated at the peak of the pandemic was a breach of their human rights. One Nation leader Pauline Hanson says the frontline workers had been "vindicated", while legal experts believe that the Queensland ruling may set a precedent for similar cases in other states.

Radio star Jones fights to overturn gag order

A Brisbane court is hearing an application to lift an injunction that prevents veteran radio broadcaster Alan Jones from repeating imputations that prompted a record defamation payout in 2018. The Wagner family was awarded $3.75m in damages after the Supreme Court ruled that Jones had defamed them in a series of broadcasts on 2GB and 4BC. The Wagners’ lawyer has argued that the injunction simply prevents Jones from repeating the allegations and does not prevent him from discussing the case.

Alan Jones defamed Wagner family over Grantham floods

Macquarie Media will have to pay Toowoomba’s Wagner brothers $3.75 million after it and broadcaster Alan Jones lost a defamation case in the Supreme Court of Queensland. The case related to allegations by Jones in broadcasts in 2014 and 2015 that the quarry the brothers owned had caused the deaths of 12 people in the Grantham floods in 2011. The Wagner brothers had been seeking $4.8 million in damages. Justice Peter Flanagan directed Jones and his programs to never again repeat his defamatory comments.

Decision day for Alan Jones in Wagner defamation case

Supreme Court of Queensland Justice Peter Flanagan will hand down his decision in a defamation case involving broadcaster Alan Jones on 12 September. The Toowoomba-based Wagner brothers are seeking $4.8 million in damages over 32 broadcasts made by Jones in 2014 and 2015. The Wagners claim they were defamed by imputations that the collapse of a dirt wall in a quarry they owned caused the deaths of 12 people in floods in 2011. They are also suing Jones and co-defendants 4BC and Harbour Radio regarding allegations concerning the Wellcamp airport near Toowoomba; journalist Nick Cater is a defendant in regard to one of the 32 broadcasts.

Charges over union-Mirvac ‘secret deals’

Former union official Dave Hanna and Mirvac former managers Adam Moore and Mathew McAllum have been arrested and charged with offences relating to work done on Hanna’s home for no payment. Queensland Police allege the arrangement involved more than $A400,000 in free work done at the property. The accused are due to appear in the Brisbane Magistrates Court on 25 January 2017.

The former MD of Queensland Nickel, Clive Mensink, was evasive when asked about the company’s debts but, under pressure from lawyers, he said they were unlikely to be paid. Mensink appeared in the Supreme Court in Brisbane on 20 April 2016 in a case involving an injunction to stop FTI Consulting, acting as voluntary administrator for Queensland Nickel, from pursuing two call notices against QNI Resources and QNI Metals totalling $A190m.

Palmer may be forced to end his lawfare

Lawyers representing the administrators of Queensland Nickel may order legal action against China-based CITIC to be discontinued, due to concerns about the likely cost of further litigation. The Clive Palmer-backed company launched a $A137.5m civil damages claim against CITIC in 2015, although most of the legal action by Palmer against the Chinese group is being undertaken via Mineralogy. Queensland Nickel’s administrators may also seek to settle litigation over an alleged breach of environmental laws in order to avoid further legal costs.

Activists fail to block Adani’s mine

The Land Court of Queensland has recommended that the State Government grant a mining lease to Adani for its proposed Carmichael coal mine. However, Land Court president Carmel MacDonald added that the mine’s approval should be subject to a number of conditions, and concluded that the economic benefits of the $A16.5bn project would be greater than its environmental impact. Environmentalists have sought to block the project.

Rinehart mine would damage groundwater

The Land Court of Queensland has been told that the proposed Kevin’s Corner thermal coal mine should not proceed due to concerns about its impact on groundwater reserves. The $A4.2bn project is being undertaken by Gina Rinehart’s Hancock Coal and India-based GVK, which are facing opposition from environmentalists and farmers. The mine would export up to 30 million tonnes of coal each year.

IBM blames Qld health division for $1.2b payroll debacle

The Supreme Court heard on 25 August 2015 that the Queensland Government was to blame for delays and cost increases in the health payroll system. IBM’s lawyer, Shane Doyle, told the court the problems were caused by the health department changing the project’s scope. The Government alleges that IBM made "negligent and misleading" representations of its credentials.
