A case that will begin in the Supreme Court of Western Australia on 24 June is the latest in a number of cases that have resulted from efforts by former business partners Peter Wright and Lang Hancock to "carve up" their WA iron ore interests in the 1980s. Lucrative iron ore assets and billions of dollars in iron ore royalties are at stake in this latest case, along whether Wright’s descendants are entitled to some of Hancock Prospecting’s interests in the Hope Downs and East Angelas mining tenements. The case is likely to run for around three months.

Andrew Forrest sues Mark Zuckerberg’s Facebook over scam ads

Fortescue Metals Group founder Andrew Forrest has filed criminal charges against social media giant Facebook in the Magistrates Court of Western Australia. Forrest alleges that Facebook has been "criminally reckless" in failing to take sufficient action to block fake advertisements that use his name and image to promote cryptocurrency scams on its platforms. Forrest has also accused Facebook of breaching Australia’s money-laundering laws. Forrest previously filed a US civil case against Facebook in September 2021.

CITIC ruling a bonanza for Palmer

The Supreme Court of Western Australia has issued draft orders outlining the terms for CITIC to acquire Balmoral, an entity controlled by Clive Palmer which holds the mining rights to an iron ore deposit in the Pilbara. This will give CITIC access to an additional one billion tonnes of iron ore. Palmer receives about $523m a year in royalties from CITIC’s existing iron ore operations in WA.

Judge’s news dictate sets risky precedent

A Curtin University academic has expressed concern about a court ruling about disclosing the identify of a psychologist who was found guilty of professional misconduct. The Family Court of Western Australia ruled that ‘The Australian’ must submit a draft article for its approval before the story can be published, as the Family Law Act prevents the identification of witnesses in family law proceedings. Associate professor of journalism Joseph Fernandez says the ruling is "troubling" and has implications for freedom of the press.

Hancock loses stoush over royalties

The Supreme Court of Western Australia has ruled in Wright Prospecting’s favour in the latest round of its dispute with Gina Rinehart’s Hancock Prospecting. The long-running dispute centres on the right to royalties from the Hope Downs iron ore tenements. The court has rejected Hancock’s bid to have Wright Prospecting’s legal action put on hold until the outcome of its appeal against a 2018 court ruling is known.

Forrest ruling wipes out mining lease applications

A High Court ruling in August 2017 concerning mining lease applications lodged over pastoral land owned by Andrew Forrest in Western Australia has led to new mining legislation in that state. However, the legislation will not cover mining lease applications that are currently in progress, and Tony Bullen from the Department of Mines, Industry Regulation & Safety says fresh applications will have to be submitted.

Kidman wins lithium fight against Marindi Metals

The Supreme Court of Western Australia has ruled in favour of Kidman Resources in a legal dispute over the Earl Grey lithium project. Marindi Metals had claimed that it had a binding deal to acquire the project’s lithium rights, which Kidman had disputed. The court found that there was no draft heads of agreement between Kidman and Marindi. Kidman MD Martin Donohue has welcomed the judgment, saying the company can now focus on developing Earl Grey and its other projects.

I was stooge for AWU: Blewitt

Former Australian Workers’ Union official Ralph Blewitt has appeared in the Perth Magistrate’s Court to face 31 charges of fraud. The charges relate to his alleged involvement with the AWU Workplace Reform Association in the 1990s. The Association was set up by then AWU senior official Bruce Wilson, who received legal advice from former prime minister Julia Gillard on its establishment. Blewitt said after his court appearance that the charges relate to monies of over $A300,000 linked to the fund. He claims that he was just the fund’s "bagman", and that he was set up to be the "fall guy".

Rinehart, Wright win legal battle against Rio Tinto

The High Court of Australia has ruled in favour of Hancock Prospecting and Wright Prospecting in a case against Rio Tinto over some $A130 million in royalties. Lawyers for the litigants argued successfully that Rio Tinto owed royalties to Hancock Prospecting and Wright Prospecting, as the mining giant still controlled the mineral tenements and exploration licences in Western Australia’s Pilbara region.

Violent nurse suspended after assaults

Western Australia’s State Administration Tribunal has suspended Michael Cummins’ registration as a nurse for 16 months. He pleaded guilty to charges of professional misconduct arising from incidents at two nursing homes. He had been accused of assaulting a dementia patient and a patient care assistant, as well as falsifying medical records and failing to give medication to patients. Cummins had previously been given a suspended jail sentence after pleading guilty to charges of assault
