The Fair Work Commission is considering a proposal that would insert the right into industry awards for greater flexibility in terms of paid time off, with the possibility that staff could double their leave by taking half of it at half pay. Unions and employer groups are understood to be in agreeance that the right to request leave at half pay should lie with the employee rather than the employer, but Australian Industry Group CEO Innes Willox says it is essential that such arrangements are by agreement, given that employers may find it hard to accommodate longer staff absences.

Paid leave for ANZ’s fire volunteers

The ANZ Bank has advised that its employees who are volunteer firefighters will be entitled to special paid leave in addition to their standard leave entitlements. ANZ provides its employees with up to five days of paid community service leave each year, and staff who use all of this leave during the current bushfire crisis will be able to access the bank’s special leave policy.

Challenge to ruling on shift workers’ leave

The federal government and Mondelez International plan to challenge a Federal Court decision regarding shift workers’ leave entitlements in the High Court. Mondelez, with the support of the government, had sought to cut personal and carers leave entitlements for shift workers at its Cadbury factory in Tasmania, but the Federal Court rejected its bid. Employer groups state the decision would give those who work industry-specific rosters or long hours much greater leave entitlements than those who work standard 38-hour weeks. Attorney-General Christian Porter said the Federal Court’s decision would create inequality between workers, while he noted employers had estimated the decision could increase their costs by up to $2 billion a year.

Thorburn to take two long breaks

National Australia Bank has advised that CFO Gary Lennon will become acting CEO while Andrew Thorburn is on extended leave. Thorburn will go on annual leave after NAB’s upcoming AGM, but he will return to work before the final report of the financial services royal commission is released on 1 February. He will subsequently go on long service leave for a month. Thorburn says the two breaks will allow him to "reflect and recharge". It has been a challenging year for the banking sector, and NAB in particular.

$400m bill for training

The federal government has criticised a push for union members to receive paid leave to attend training programs. The resolution will be put to Labor’s upcoming national conference, but the government has warned that it would cost the national economy about $1.3 billion a year and the Victorian economy $358.3 million a year if it applied to all members of a union. However, Labor has stressed that the policy would apply only to elected union delegates. Shadow workplace relations minister Brendan O’Connor argues that union delegates are already permitted to take training leave during working hours at the majority of unionised workplaces.

No pay for workers’ blood donations

The Fair Work Commission has rejected a union’s push for employees to be given two hours of paid leave to donate blood up to four times a year. In ruling against the application by the shop assistants’ union, the FWC took into account factors such as the likely impact on productivity and the fact that donating blood is voluntary and can usually be done outside of working hours.

Union claims not practical

The Fair Work Commission has rejected claims by the union movement for paid leave for family and domestic violence, after some months of consideration. It has also rejected applications for changes to part-time and casual employment; both measures would have served as a deterrent to employment. The FWC is now considering an application to have paid leave for giving blood to be inserted in some awards, despite blood donation being a strictly voluntary act and something that employees can do in their own time.

Victims earn paid leave from work

Prime Minister Malcolm Turnbull says national domestic violence leave is being examined by the Productivity Commission in its review of the Fair Work Act. Turnbull is also open to considering an Australian Labor Party proposal for all workers to have access to five days of family violence leave. However, Small Business Minister Kelly O’Dwyer is concerned that such leave may deter employers from hiring women. The Queensland Government plans to offer 10 days of domestic violence leave to all public servants.
