Attorney-General Christian Porter and Communications Minister Paul Fletcher held talks with media industry representatives on 3 July. The meeting failed to ease the media sector’s concerns about Australian Federal Police raids on the ABC’s Sydney office and the home of a News Corp Australia journalist in early June, and whether journalists will face prosecution as a result of the raids. Media executives have also expressed reservations about the government’s plans for the parliamentary joint committee on intelligence and security to hold an inquiry into press freedom.

Digital giants must take rap for online comments

Australian media companies receive little or no revenue from making their content available via digital platforms such as Facebook and Google. However, a recent court ruling means local media companies can be held liable for defamatory comments that are posted on their Facebook pages. At the same time, Facebook’s terms of use do not allow media companies to turn off comments. The federal government needs to take action regarding the issue of control over media content on digital platforms; it must also clarify who is liable for defamatory comments that are posted on such platforms.

Press freedom probe backed

The parliamentary joint committee on intelligence and security will undertake an inquiry into the impact of police and intelligence agencies’ powers on freedom of the press. The inquiry was approved by federal cabinet on 2 July, and follows the recent police raids on the ABC’s offices and the home of a News Corp Australia journalist. Labor proposes to establish a separate inquiry into press freedom and the public’s right to know, while media companies advocate changes to laws affecting freedom of the press rather than a parliamentary inquiry.

Bauer dominates in four of Top 10 Magazine categories

Analysis of Roy Morgan’s readership results for the 12 months to March 2019 shows that Bauer Magazines is the most widely read magazine publisher in four of the Top 10 Magazine categories: Mass Women’s Magazines, Motoring Magazines, TV Magazines and Women’s Lifestyle Magazines. Bauer is a Top 3 publisher in a total of eight of the Top 10 categories, which also includes Food & Entertainment Magazines, Home & Garden Magazines, Health & Family Magazines and Women’s Fashion Magazines categories. Other publishers to perform well include Medium Rare (which is the most widely read publisher for Food & Entertainment Magazines and Business, Financial & Airline Magazines) and Pacific Magazines (which is the most widely read publisher for Home & Garden Magazines and Health & Family Magazines).

Almost 14 million Australians have Subscription or Pay TV

New research from Roy Morgan shows that 13,975,000 Australians aged 14+ now have access to some form of Pay TV/Subscription TV or Subscription Video on Demand (SVOD), up 7.9% on a year ago. Nearly 11.5 million Australians now have a Netflix subscription in their household, up by 17.6% on a year ago, while Stan is now accessible by nearly 2.9 million Australians, up by 43.2% in the last 12 months. Other Pay TV/SVOD services to have grown quickly over the past year include Amazon Prime Video (+130.7%), YouTube Premium (+37%) and Fetch (+20.9%). Meanwhile, analysis using Roy Morgan’s Helix Personas consumer segmentation and data integration tool shows that Netflix has a strong appeal to Australians from all walks of life, while traditional Pay TV provider Foxtel is more popular with families than with other psychographic segmentations.

Follow the UK on press freedom, PM urged

A court ruling that media companies can be regarded as the publisher of comments posted on Facebook has prompted industry leaders to call for legislative action. News Corp Australasia executive chairman Michael Miller says the federal government should adopt similar laws to those in the UK, whereby publishers are not legally responsible for comments that their readers post on their social media pages. ABC MD David Anderson also expressed concern about the ruling, while Nine Entertainment CEO Hugh Marks said Facebook should be subject to the same regulations as traditional media.

Facebook ruling sparks call for defamation law overhaul

The Supreme Court of New South Wales has ruled that media companies can be deemed to be the publisher of comments that are posted on their Facebook pages, rendering them liable for comments that are defamatory. The court ruled that News Corp Australia and Nine Entertainment Company are responsible for users’ comments posted on Facebook, arguing that they are able to monitor such comments and prevent defamatory ones from being published. News Corp Australia says the ruling demonstrates the need for changes to the nation’s defamation laws.

News takes AFP raid fight to High Court

The ABC and News Corp Australia will both challenge the constitutional validity of the Australian Federal Police’s recent media raids. The ABC will ask the Federal Court to rule that the AFP’s warrant was invalid on a number of grounds, including that it infringed the public broadcaster’s implied right of political communication. News Corp Australia will use similar arguments in the High Court; it will also seek confirmation from the AFP that it is no longer investigating the media group itself or journalist Annika Smethurst.
