The Federal Court of Australia has upheld a bid to obtain the identities of people who allegedly downloaded illegal copies of a US film. Dallas Buyers Club LLC took legal action against several ISP to obtain the names and residential addresses of Australians associated with more than 4,700 IP addresses that were used to download "Dallas Buyers Club". Australian Attorney-General George Brandis and Communications Minister Malcolm Turnbull will present their copyright law proposals to federal Cabinet on 9 December 2014. The proposed laws are not as tough as expected by rights holders. Instead of being penalised, illicit downloaders will receive written messages warning them that they are breaching copyright laws. Access to web sites hosting pirated materials will be blocked

Police to get access to data records

The Australian Government introduced new data retention laws into Parliament on 30 October 2014. Access to retained data will be restricted to criminal law enforcement agencies. Australian Federal Police Commissioner Andrew Colvin said the new laws could be used to prosecute those who download music and films without permission from copyright holders

Telstra has lodged its submission to the Australian Government’s review of copyright infringement laws. The group argues that new requirements to warn off subscribers if they are caught illegally downloading content should apply to fixed-line services only, not to mobile ones. It also wants an exemption for business customers, claiming this will reduce the complexity of the new measures. Telstra seeks indemnity against any legal action by rights holders, and a contribution by them to the cost of the new scheme

It follows the release of a discussion paper by Attorney-General George Brandis and Communications Minister Malcolm Turnbull, which examines options for combating the problem of internet piracy. The forum is likely to be held later in August 2014
