Native title challenge to Forrest deal

Billionaire miner and philanthropist Andrew Forrest and his wife Nicola have bid to buy two adjoining cattle stations in the Kimberley region of Western Australia. Traditional owners of the Fitzroy also bid for the Jubilee Downs and Quanbun Downs stations, but they bid $25 million, while the Forrests are believed to have bid $30 million. The Yanunijarra Aboriginal Corporation has asked WA Lands Minister Ben Wyatt to intervene in the transfer of the leases of the two stations to the Forrests, and a spokesperson for Wyatt says transfers of pastoral leases are subject to a public interest test if they result in the holder of the lease exceeding 500,000 hectares.

Forrest weighs return to High Court in cattle station battle

Western Australia’s Court of Appeal has ruled in favour of Onslow Resources in the latest round of a legal dispute with mining magnate Andrew Forrest. The court has rejected an appeal by Forrest’s private company against the Supreme Court’s ruling that a licence associated with Onslow’s sand mining operations should be renewed. Onslow mines sand from the Ashburton River, which runs through Forrest’s Minderoo cattle station. A spokesman for Forrest says the businessman will consider appealing the decision.

Forrest wins fight to keep miners off his land

The High Court has upheld Andrew Forrest’s challenge to the validity of licences that were issued to Yarri Mining and ­Onslow Resources to mine sand on his Minderoo cattle station in Western Australia. The court ruled that the private companies’ mining proposals and mineralisation reports had been lodged after their mining lease applications, in breach of the Mining Act. The ruling could have implications for other mining licences in WA, and Gilbert + Tobin partner Marshall McKenna estimates that around five per cent of mining leases in the state could now be invalid.
