Unlawful strikes cost ‘woeful’ CFMEU $300,000

The Construction, Forestry, Mining & Energy Union has been ordered to pay $A300,000 in fines arising from unprotected strike action at three Queensland building sites in May 2011. The Federal Court described the CFMEU as a "recidivist" with a long history of failing to comply with workplace laws. The Communications, Electrical & Plumbing Union has been fined $A130,000 for participating in the unlawful strike action, and the court noted that it has a better record of complying with workplace laws than the CFMEU.

Games site hostage to union ‘ploy’

The Federal Court has been told that stopwork action at a key 2018 Commonwealth Games construction site was unlawful and unconscionable. Fair Work Building & Construction claims that the industrial action by the Construction, Forestry, Mining & Energy Union was designed to get lead contractor Hansen Yuncken to accept a new enterprise bargaining agreement. The CFMEU says the two-hour stopwork meetings – which were held twice a day – were needed to inform workers about the Coalition’s proposed industrial relations reforms in the lead-up to the federal election.

CFMEU fights Lendlease to fly flags

The removal of union flags from cranes at Lend Lease’s apartment project in Brisbane has triggered a strike by construction workers. Lawyers for the Construction, Forestry, Mining & Energy Union argued before the Fair Work Commission that Lend Lease’s action was an attack on "a workplace right", but the commission rejected this argument and ordered workers to return to work.

Building union facing penalties

The Fair Work Building & Construction inspectorate wants the Federal Court to impose financial penalties against the Construction, Forestry, Mining & Energy Union and 21 of its officials. The case centres on industrial action at two construction sites in Queensland in 2013, which was aimed at compelling contractors to sign an enterprise agreement. The inspectorate has identified 822 separate alleged breaches of the law by the union and its officials.

Strike threat to Qld $70b LNG debut

Three separate LNG exporting plant projects worth a combined $A70bn are being pursued in the Gladstone region of Queensland by consortia led respectively by Santos, Origin Energy and BG Group. The latter has made the most progress, but is now also likely to be the most affected by potential strikes as the Construction, Forestry, Mining & Energy Union has applied for protected industrial action. Workers may down tools from 7 August 2014 over talks on a new enterprise bargaining agreement. They seek a "four weeks on, one week off" roster instead of the current "three weeks on, one week off’
