Almost two million Australian employees who are covered by the modern industrial awards system will now have the option of cashing out part of their annual leave entitlement. The Fair Work Commission’s decision to allow cashing out has the support of the Australian Chamber of Commerce & Industry, although ACTU secretary Dave Oliver has expressed concern about the potential ramifications of the decision. The FWC is expected to issue a ruling on weekend penalty rates in September 2016.

Victoria’s Industrial Relations Minister Natalie Hutchins has proposed a review of regulations governing long-service leave. Options that are canvassed in a discussion paper include allowing workers to cash out their long-service leave or take it in small amounts rather than one or two large blocks at a time. The Victorian Trades Hall Council also advocates portability of long-service leave entitlements and applying penalty rates to such leave.

Australia’s Fair Work Commission has ruled that employers are entitled to require an employee covered by an industrial award to take annual leave if they have at least seven weeks of unused leave. Meanwhile, workers who have at least four weeks of accrued leave will be entitled to cash out two weeks’ leave. The Commission noted that cash-out provisions are included in many enterprises agreements. The ruling has been welcomed by employers’ groups, but the ACTU says it will disadvantage many people on low wages.
