Public holiday penalty rates prompted many Perth retailers and restaurants to remain closed on 26 January 2015. Sorrento Restaurant in Northbridge is among those that opted to trade on Australia Day, but proprietor Fiona Dilanzo says this was only due to a 10 per cer surcharge that was imposed on customers. The Chamber of Commerce & Industry of Western Australia favours a single penalty rate for working on public holidays and weekends

The Australian Taxation Office (ATO) has issued a new guidance note on the practice of splitting income from a discretionary trust. The structure is becoming increasingly popular among professionals such as law firm partners, after the deregulation of the legal services market. While conceding that the method is "legally permissible", the ATO says it will monitor whether risk reviews and audits may be required

The Federal Court of Australia has rejected a bid to overturn the Fair Work Commission’s ruling that penalty rates for hospitality workers should be reduced. The appeal was lodged by the United Voice union, after the Restaurant & Catering Association of Victoria and Australian Business Industrial succeeded in a bid to have Sunday penalty rates reduced. Original article by Mathew Dunckley

Australia’s Fair Work Ombudsman, Natalie James, believes that the industrial awards system remains too complex and employers find it difficult to understand. Many of the enquiries fielded by James’s office concern wage rates under the modern awards system. James says the Fair Work Commission’s review of industrial awards should ensure that in future all awards are consistent with the national employment standards
