The Australian Competition & Consumer Commission has been directed to set up a mandatory code of conduct under which Google and Facebook will be required to pay news publishers for using their content. Treasurer Josh Frydenberg says it is only reasonable that those who create content are rewarded for it. Facebook and Google had initially been directed to set up a voluntary code of conduct for content payment by November, but the two technology companies had been accused by media firms of not genuinely engaging in negotiations on the issue. Nine Entertainment CEO Hugh Marks has praised the government for taking "taking swift and decisive action" on the issue.

ACCC takes fight up to digital giants

The Australian Competition & Consumer Commission has advised that it now has more than 10 active investigations into digital platforms, compared with five when the final report into its landmark inquiry into the sector was released in July. ACCC chairman Rod Sims says it is examining both competition and consumer issues in relation to digital platforms. He notes that the use and abuse of consumers’ data by such platforms is one of the key concerns.

New ACCC case targets Google

The Australian Competition & Consumer Commission is preparing an antitrust case against Google over the collapse of mobile advertising group Unlockd. The ACCC’s case will centre on whether Google’s conduct in relation to Unlockd constituted a breach of section 46 of the Competition and Consumer Act, which prohibits the misuse of market power. Google is also the subject of antitrust proceedings in the US.

Google faces court case over misled users

The Australian Competition & Consumer Commission has launched legal action against digital giant Google for misleading users of Android smartphones with regard to the amount of data it collects and how the data would be used. Amongst other things, the ACCC contends that Google failed to inform consumers that it would continue to receive location data from their smartphones if they switched off the ‘location history’ option. Google faces potential fines of up to $10m or 10 per cent of its annual turnover if the alleged breaches of Australian consumer law are proven in the Federal Court.

Watchdog targets Google’s advertising

Australian Competition & Consumer Commission chairman Rod Sims has told the ThinkTV conference that he wants advertising technology companies such as Google to be more transparent about their pricing. Sims says insufficient transparency means advertisers are unsure what they are paying for, and that higher advertising prices are passed on to consumers in the form of higher prices for goods and services. Gary Nissim, the founder and MD of search agency Indago Digital, says there is still uncertainty as to how Google calculates cost per click and how its algorithms work.

Big tech urged to promote quality journalism

Attendees at the "Navigating the News" conference in Hobart heard Facebook and Google being urged to revise their algorithms to give quality journalism better treatment. Nicholas Gray, the CEO of "The Australian" told the conference that commercial news outlets needed to attract subscriptions in order to remain viable, but that Facebook and Google’s algorithms did not favour the quality stories that the outlets generate. Nic Hopkins from Google Australia and New Zealand said it was not its job to "censor" the internet.

Google appoints Melanie Silva as Australia and New Zealand managing director

Melanie Silva has been announced as Google Australia and New Zealand’s new MD. Silva, who has been with Google for over a decade and who is currently based in Singapore, replaces Jason Pellegrino. Pellegrino has joined online real estate classifieds company Domain. Karim Temsamani, Google president of Asia Pacific, says Silva is a great leader who gets the best out of people. Silva takes up her new role on 1 October.

Tech giants face $10m fines under security laws

The federal government will introduce new laws that aim to boost efforts to detect terrorist and criminal activity via electronic surveillance. The laws, which were developed in consultation with telcos, internet firms and telecommunications device makers, include fines of up to $10 million for companies that refuse to provide access to secret data. They have been introduced after Prime Minister Malcolm Turnbull complained in 2017 that terrorists and criminals are using secret message services such as WhatsApp to avoid surveillance; he promised to take action to require technology firms to work with law enforcement agencies to detect such activity.

SEEK warns of flat profits, seeks loyalty

Shares in employment classifieds and services company SEEK fell by 8.8 per cent on 6 August, after it announced a profit downgrade and writedown. SEEK will write down $178 million on its investments in Mexico and Brazil, while its expects its 2018-19 net profit after tax to be around the $200 million result it achieved in 2017-18. A survey of analysts by Bloomberg had forecast a 2018-19 result of $240 million. SEEK CEO Andrew Bassat notes that it is reinvesting revenue in preference to targeting profit growth; SEEK expects its 2018-19 revenue to grow by between 16 and 20 per cent.

Google revenue hits $3b, loss for Facebook

Google Australia’s accounts for 2017 reveal that it booked gross revenue of $A3.06 billion. Net revenue, on which Google is taxed in Australia, totalled $A1.022 billion. Google Australia paid tax of $A37.2 million in 2017 and it made a profit of $A125.1 million. Meanwhile, Facebook Australia boasted revenue of $A476.8 million in 2017, up from $A326.9 million in 2016. It reported a $A9.6 million loss as a result of a tax charge.
